Is the Data Protection Board of India operational?

No. The Data Protection Board of India has no appointed chairperson and no appointed members. It cannot receive a complaint and it cannot pass an order. The recruitment advertisement was published in Employment News on 6 June 2026 for a chairperson and four members, and no appointment has been announced since.
Readers often run three separate things together. The Act established the Board in law. Sections 18 to 26, which set out its establishment, composition and terms of appointment, came into force in November 2025. The Government has not appointed anyone to it. Only the first two steps are complete.
Published commentary rarely states a fourth point. Sections 27 and 28, which give the Board its powers and its procedure, are not in force. They start on 13 May 2027 along with sections 33 and 34, which carry the penalties and the adjudication machinery. So even a fully appointed Board would have no power to adjudicate before that date.
The Government sought nominations for appointment on 6 May 2026 and published the recruitment advertisement in Employment News on 6 June 2026. The advertisement is for one chairperson and four members. Five is the only number of posts on the public record. A written answer in the Lok Sabha on 12 August 2026 confirmed the advertisement.
The Madhya Pradesh High Court at Indore directed a petitioner to file a representation before the Board in Parth Sharma v. Union of India. The direction was given although the Board was not functioning.
Why this matters
The Board is the only body that can impose a penalty under the Act. A Data Principal who wants to complain about a Data Fiduciary has no forum to complain to. Section 39 bars the civil courts from any matter the Board is empowered to decide, and is already in force. Section 27, which gives the Board those powers, is not in force, so the reach of that bar is untested.
